Work-for-Hire

Work-for-hire is a contract clause that assigns copyright of a created work to the commissioning party. In US law, the employer or commissioner automatically holds the copyright; in European jurisdictions, moral rights remain with the creator, but exploitation rights can be transferred. In an ISMS, work-for-hire is relevant when engaging external developers: clear contractual terms ensure the organization obtains the necessary rights to developed software. ISO 27001 Annex A.5.32 requires the protection of intellectual property, which includes contractual safeguards.
